Retail leasing

Leasing premises to run your business from can be an ideal way to secure the right location. If you're going to take a lease or have an agreement to lease, you need to know what questions to ask before signing the contract, and where to look for more information.

Firstly, check that you can carry out all of your business activities from the premises.

If your lease imposes conditions that you feel are harsh and unnecessary you should familiarise yourself with the unconscionable conduct provisions of the Competition and Consumer Act 2010 (CCA).

State and territory governments all have laws protecting retail lease tenants. There are some specific differences among them, so make sure you are familiar with the relevant law.

  • Check with your solicitor or business association if you don't understand something about your lease.
  • Find out about Unconscionable conduct in retail leasing from the Australian Competition and Consumer Commission (ACCC) small business helpline on 1300 302 021.
  • Find out about retail leasing in your state or territory.
